On the authority of 'Imran ibn Husayn al-Khuza'i (may Allah be pleased with both of them), that a woman from the tribe of Juhaynah came to the Messenger of Allah (peace be upon him) while pregnant from fornication. She said: "O Messenger of Allah, I have committed an offense deserving of a prescribed punishment, so carry it out upon me." The Prophet of Allah (peace be upon him) called her guardian and said: "Treat her well, and when she gives birth, bring her to me." He did so, and the Prophet of Allah (peace be upon him) ordered that her garments be bound tightly around her, then he ordered that she be stoned. Then he prayed the funeral prayer over her. Umar said to him: "You pray over her, O Messenger of Allah, when she has committed fornication?" He said: "She has repented with such a repentance that if it were distributed among seventy of the people of Madinah, it would suffice them. And have you found anything better than her offering herself to Allah the Most High?!" Narrated by Muslim.

"A woman from Juhaynah": in Sahih Muslim she is described as being from Ghamid, and Ghamid is a branch of Juhaynah. "I have committed an offense deserving of a prescribed punishment" (asabtu haddan): meaning she committed something for which a prescribed punishment is due. "Her garments were bound tightly" (fa shuddat): meaning their edges were gathered to cover her. "Umar said" (qala lahu 'Umar): seeking to understand the wisdom, not objecting. "Seventy": meaning seventy sinners. "It would suffice them" (la wasi'at-hum): it would be enough to remove their sins. "Better" (afdal): greater. "She offered herself" (jadat bi-nafsiha): she gave herself up to gain Allah's pleasure and forgiveness.

Flogging is established in the Book of Allah the Most High for the unmarried fornicator, and stoning is established by the Sunnah of the Messenger of Allah (peace be upon him) for the married fornicator. Stoning was among what was revealed in the Quran but its recitation was abrogated while its ruling remains in effect. The eagerness of the believer to purify himself so that he may meet Allah the Almighty while He is pleased with him. It is permissible for a person to confess fornication upon himself for the purpose of purification through the prescribed punishment, not for the purpose of exposing himself. Whoever repents from a sin and comes seeking the implementation of the prescribed punishment, it is carried out upon him. But whoever repents between himself and Allah, and Allah conceals him, then repentance suffices him. Worldly punishment expiates the sin of the transgression when accompanied by remorse and repentance. The prescribed punishment for fornication is not carried out upon a pregnant woman until she gives birth. If her punishment is flogging, then it is delayed until she recovers from postpartum bleeding; and if it is stoning, then it is delayed until the child no longer needs her, even if through the milk of another.
