حديث 1605·الباب 282 · باب النّهي عن تعذيب العبْد والدّابة والمرأة والولد بغير سبب شرعي أو زائد على قدر الأدب·رياض الصالحين · Riyad Al Salihin

عنِ ابْنِ عُمر رضي اللَّه عنْهُمَا أنَّ النبيَّ صَلّى اللّهُ عَلَيْهِ وسَلَّم قَال: «منْ ضرب غُلامًا له حَدًا لم يأتِهِ، أو لَطَمَهُ، فإن كَفَّارتَهُ أن يُعْتِقَهُ» رواه مسلم.

Ibn Umar (may Allah be pleased with them both) reported that the Prophet (peace and blessings be upon him) said: "Whoever strikes a slave boy of his (as) a prescribed punishment (hadd) which he did not incur, or slaps him, then his expiation is that he set him free." Reported by Muslim.

الشرح · explanation

حدًا: أي العقوبة المقدرة في الشرع. لم يأته: أي لم يفعل ما يقتضي ذلك الحد. كفارته: أي مكفر إثم ذلك عنه.

"Hadd": that is, the punishment fixed in the Sacred Law. "Lam ya'tihi (which he did not incur)": that is, he did not do what would call for that prescribed punishment. "Kaffaratuhu (his expiation)": that is, what wipes away the sin of that from him.

من ضرب غلامًا مملوكًا له بلا ذنب يستحق معه العقوبة ولم يفعل الغلام ما يُوجب حَدَّه فإن كفَّارة تلك المعصية أن يُعْتِقَه.

Whoever strikes a slave he owns without a sin deserving punishment, and the slave did nothing requiring a prescribed punishment (hadd) against him, then the expiation for that offense is that he set him free.
