حديث 1826·الباب 370 · بابُ المنثورات والمُلَح·رياض الصالحين · Riyad Al Salihin

عَنْ أبي هُرَيْرَةَ رضي اللّه عَنْهُ عَن النَّبيِّ صَلّى اللّهُ عَلَيْهِ وسَلَّم قَالَ: «اشْتَرَى رَجُلٌ مِنْ رَجُلٍ عقَارًا، فَوَجَد الذي اشْتَرَى الْعَقَارَ في عَقَارِه جَرَّةً فِيهَا ذَهَبٌ، فقالَ لهُ الذي اشْتَرَى الْعَقَارُ: خُذْ ذَهَبَكَ، إنَّمَا اشْتَرَيْتُ مِنْكَ الأرْضَ، وَلَمْ أشْتَرِ الذَّهَبَ، وقالَ الَّذي لَهُ الأرْضُ: إنَّمَا بعْتُكَ الأرضَ وَمَا فِيهَا، فَتَحاكَما إلى رَجُلٍ، فقالَ الَّذي تَحَاكَمَا إلَيْهِ: أَلَكُمَا وَلَدٌ؟ قَالَ أحدُهُمَا: لي غُلامٌ، وقالَ الآخرُ: لي جَارِيةٌ، قالَ أنْكِحَا الْغُلامَ الجَاريَةَ، وَأنْفِقَا عَلى أنْفُسهمَا مِنْهُ وتصَدَّقَا» متفقٌ عليه.

Abu Hurayrah (may Allah be pleased with him) reported that the Prophet (peace and blessings be upon him) said: "A man bought a piece of property from another man, and the buyer of the property found in it a jar containing gold. The buyer said to him: 'Take your gold; I only bought the land from you, I did not buy the gold.' The owner of the land said: 'I only sold you the land and what is in it.' So they took their dispute to a man, who said: 'Do you have any children?' One of them said: 'I have a son,' and the other said: 'I have a daughter.' He said: 'Marry the boy to the girl, and let them spend on themselves from it, and give in charity.'" Agreed upon (al-Bukhari and Muslim).

بيان فضل الورع وترك ما فيه شبهة من المال. هذا الحديث من أحكام شريعة من قبلنا وهي ليست شرعًا لنا على الأصح، وفي شرعنا: أن الجرة من دفن البائع فلا تدخل عند الإطلاق في البيع لأنّها ليست من جنس المبيع، وإن كانت من دفن الجاهلية فحكمها حكم اللقطة يعرفها ملتقطها سنة ثم يمتلكها فإذا ظهر صاحبها أداها إليه، وإن جهل أمرها فحكمها حكم المال الضائع توضع في بيت مال المسلمين.

An exposition of the virtue of scrupulousness (wara') and leaving what is doubtful of wealth. This hadith is from the rulings of a law prior to ours, and it is not a law for us according to the sounder view. In our law: if the jar is from the burial of the seller, it does not enter into the sale by default, because it is not of the same kind as the sold item; and if it is from the burial of the pre-Islamic period, its ruling is that of a lost-and-found item (luqatah): the finder announces it for a year and then takes ownership of it, and if its owner appears, he returns it to him; and if its situation is unknown, its ruling is that of lost property, to be placed in the treasury of the Muslims (bayt al-mal).
