عَنْ عَوْفِ بنِ مَالِكِ بنِ الطُّفَيْلِ أنَّ عَائِشَةَ رضي اللّه عَنْهَا حُدِّثَتْ أنَّ عَبْدَ اللّه ابنَ الزَّبَيْر رضيّ اللّه عَنْهُمَا قَالَ في بيْعٍ أوْ عَطَاءٍ أعْطَتْهُ عَائِشَةُ رضي اللّه تَعالَى عَنْها: وَاللّه لَتَنْتَهِيَنَّ عَائِشَةُ، أوْ لأحْجُرَنَّ علَيْهَا، قَالتْ: أهُوَ قَالَ هَذَا؟ قَالُوا: نَعمْ، قَالَتْ: هُو، للّهِ علَيَ نَذْرٌ أنْ لا أُكَلِّم ابْنَ الزُّبيْرِ أبَدًا، فَاسْتَشْفَع ابْنُ الزُّبيْرِ إليها حِينَ طالَتِ الْهجْرَةُ. فَقَالَتْ: لا وَاللّهِ لا أُشَفِّعُ فِيهِ أبَدًا، ولا أتَحَنَّثُ إلَى نَذْري، فلَمَّا طَال ذَلِكَ علَى ابْنِ الزُّبيْرِ كَلَّم المِسْورَ بنَ مخْرَمَةَ، وعبْدَ الرَّحْمنِ بْنَ الأسْوَدِ بنِ عبْدِ يغُوثَ وقَال لهُما: أنْشُدُكُما اللّه لمَا أدْخَلْتُمَاني علَى عائِشَةَ رضي اللّه عَنْهَا، فَإنَّهَا لا يَحِلُّ لَهَا أنْ تَنْذِر قَطِيعَتي، فَأَقْبَل بهِ المِسْورُ، وعَبْدُ الرَّحْمن حَتَّى اسْتَأذَنَا علَى عائِشَةَ، فَقَالا: السَّلامُ علَيْكِ ورَحمةُ اللّه وبرَكَاتُهُ، أَنَدْخُلُ؟ قَالَتْ عَائِشَةُ: ادْخُلُوا، قَالُوا: كُلُّنَا؟ قَالَتْ: نَعمْ ادْخُلُوا كُلُّكُمْ، ولا تَعْلَمُ أنَّ معَهُما ابْنَ الزُّبَيْرِ، فَلمَّا دخَلُوا، دخَلَ ابْنُ الزُّبيْرِ الْحِجَابَ، فَاعْتَنَقَ عائِشَةَ رضي اللّه عنْهَا، وطَفِقَ يُنَاشِدُهَا ويبْكِي، وَطَفِقَ المِسْورُ، وعبْدُ الرَّحْمنِ يُنَاشِدَانِهَا إلّا كَلَّمَتْهُ وقبِلَتْ مِنْهُ، ويقُولانِ: إنَّ النبيّ صَلّى اللّهُ عَلَيْهِ وسَلَّم نَهَى عَمَّا قَدْ علِمْتِ مِنَ الْهِجْرةِ، وَلا يَحلُّ لمُسْلِمٍ أنْ يهْجُر أخَاهُ فَوْقَ ثَلاثِ لَيَالٍ،  فَلَمَّا أكْثَرُوا علَى عَائِشَةَ مِنَ التَّذْكِرةِ والتَّحْرِيجِ، طَفِقَتْ تُذَكِّرُهُما وتَبْكِي، وتَقُولُ: إنِّي نَذَرْتُ والنَّذْرُ شَدِيدٌ، فَلَمْ يَزَالا بَهَا حتَّى كَلَّمتِ ابْنَ الزُّبيْرِ، وَأعْتَقَتْ في نَذْرِهَا أرْبعِينَ رقَبةً، وَكَانَتْ تَذْكُرُ نَذْرَهَا بعْدَ ذَلِكَ فَتَبْكِي حتَّى تَبُلَّ دُمُوعُهَا خِمارَهَا. رواهُ البخاري.

Awf ibn Malik ibn al-Tufayl reported that Aisha (may Allah be pleased with her) was told that Abdullah ibn al-Zubayr (may Allah be pleased with them both) had said, concerning a sale or a gift that Aisha had made: "By Allah, Aisha must desist, or I will place her under interdiction (restrict her disposal of her property)." She said: "Did he say this?" They said: "Yes." She said: "I vow to Allah that I will never speak to Ibn al-Zubayr again." When the estrangement grew long, Ibn al-Zubayr sought intercessors to her, but she said: "No, by Allah, I will never accept anyone's intercession for him, nor will I break my vow." When this became prolonged and hard upon Ibn al-Zubayr, he spoke to al-Miswar ibn Makhramah and Abd al-Rahman ibn al-Aswad ibn Abd Yaghuth and said to them: "I implore you by Allah to bring me in to Aisha (may Allah be pleased with her), for it is not lawful for her to vow to cut me off." So al-Miswar and Abd al-Rahman brought him along until they sought permission to enter upon Aisha, and said: "Peace be upon you, and the mercy of Allah and His blessings. May we enter?" Aisha said: "Enter." They said: "All of us?" She said: "Yes, all of you enter," not knowing that Ibn al-Zubayr was with them. When they entered, Ibn al-Zubayr entered behind the curtain and embraced Aisha (may Allah be pleased with her), and began imploring her and weeping. And al-Miswar and Abd al-Rahman began beseeching her to speak to him and accept from him, saying: "The Prophet (peace and blessings be upon him) forbade what you know of estrangement, and it is not lawful for a Muslim to shun his brother for more than three nights." When they had pressed Aisha much with reminders and admonition, she began reminding them and weeping, and saying: "I have made a vow, and the vow is a grave matter." But they persisted with her until she spoke to Ibn al-Zubayr, and in expiation of her vow she freed forty slaves. After that, she would remember her vow and weep until her tears wet her veil (khimar). Reported by al-Bukhari.

الشرح · explanation

لأحجرن عليها: لأمنعنها من التصرف في مالها. لا أشفع : لا أقبل شفاعة أحد. لا أتحنث: لا آثم في نذري. يناشدها: يسألها الرضا عنه. خمارها: غطاء الرأس والصدر.

"I will place her under interdiction": I will prevent her from disposing of her property. "I will not accept intercession": I will not accept anyone's intercession. "Nor will I break my vow (atahannath)": I will not incur sin by violating my vow. "Imploring her (yunashiduha)": asking her to be reconciled with him. "Her khimar": the covering for the head and chest.

جواز الهجر إذا كان للّه تعالى ويحرم إذا كان لأمر دنيوي فوق ثلاث ليال، وعائشة هجرته بما أداها اجتهادها أنه طاعة من مخالفة ابن الزبير حكمًا شرعيًا، وهو استجازته الحجر على عائشة لتساهلها بالتصرف في أموالها بيعًا أو صدقة. لا يجوز النذر في معصية، وكفارة النذر إذا لم يوف به كفارة اليمين وهي: إطعام عشرة مساكين أو كسوتهم أو إعتاق رقبة، فإن لم يستطع فصيام ثلاثة أيام.

The permissibility of estrangement when it is for the sake of Allah the Exalted, and its prohibition beyond three nights when it is for a worldly matter. Aisha shunned him because her own reasoning (ijtihad) led her to regard it as an act of obedience, on account of Ibn al-Zubayr's opposition to a legal ruling, namely his deeming it permissible to place Aisha under interdiction because of her freely disposing of her wealth through sale or charity. A vow to commit a sin is not valid, and the expiation for an unfulfilled vow is the expiation of an oath: feeding ten needy persons, or clothing them, or freeing a slave; and whoever is unable to do so must fast three days.
