حديث 152·الباب 14 · باب الاقتصاد في الطاعة.·رياض الصالحين · Riyad Al Salihin

عن ابن عبّاس رضي اللّه عنهما قال: بيْنما النَّبِيُّ صَلّى اللّهُ عَلَيْهِ وسَلَّم يَخْطُبُ إِذَا هُوَ بِرجُلٍ قَائِمٍ، فسأَلَ عَنْهُ فَقَالُوا: أَبُو إِسْرائيلَ، نَذَر أَنْ يَقُومَ فِي الشَّمْس وَلا يقْعُدَ، ولا يستَظِلَّ ولا يتَكَلَّمَ، ويصومَ، فَقالَ النَّبِيُّ صَلّى اللّهُ عَلَيْهِ وسَلَّم: «مُرُوهُ فَلْيَتَكَلَّمْ ولْيَستَظِلَّ وليَقعُد ولْيُتِمَّ صوْمَهُ» رواه البخاري.

Ibn Abbas (may Allah be pleased with them both) reported: While the Prophet (peace be upon him) was delivering a sermon, he noticed a man standing. He inquired about him, and they said: "That is Abu Isra'il. He made a vow to stand in the sun without sitting, without seeking shade, without speaking, and to fast." The Prophet (peace be upon him) said: "Command him to speak, to seek shade, to sit down, and to complete his fast." Narrated by al-Bukhari.

"Abu Isra'il" was a man from the Ansar.

النذر بالسكوت ليس قربة في شريعة الإسلام. لا يقبل اللّه تعالى عملًا لم يشرعه، ولم يأذن به، ولم يجعله قربة. ليس كل ما كان قربة في عبادة يكون قربة في غيرها. لا ينعقد النذر على معصية أو تعبُّد لم يأذن به الشرع: كالمشي إلى الحج حافيًا، والجلوس تحت الشمس وغير ذلك. النية الصالحة لا تكفي وحدها؛ بل لا بد أيضًا من موافقة العمل للسُّنَّة. إذا كان في فعل الإنسان حقّ وباطل فإنّه يُنهَى عن الباطل ويُوافَق على الحقّ. عدم وجوب الكفارة على من نذر معصيةً أو ما لا طاعة فيه، لأنّ الرسول صلّى اللّه عليه وسلّم لم يأمر أبا إسرائيل بالكفارة.

A vow of silence is not considered an act of devotion in the Shari'ah of Islam. Allah, the Most High, does not accept a deed that He has not legislated, authorized, or made an act of devotion. Not everything that is an act of devotion in one form of worship is necessarily an act of devotion in another. A vow to commit a sin or a self-imposed act of worship not sanctioned by the Shari'ah is not binding — such as vowing to walk barefoot to Hajj, or sitting under the sun, and the like. A righteous intention alone is not sufficient; the deed must also conform to the sunnah. When a person's action contains both what is right and what is wrong, he is to be prohibited from the wrong and approved for the right. There is no obligation to offer expiation for one who makes a vow involving a sin or an act devoid of obedience, because the Messenger of Allah (peace be upon him) did not command Abu Isra'il to offer expiation.
