حديث 72·الباب 6 · بابُ التقوى.·رياض الصالحين · Riyad Al Salihin

عَنْ أبي طَريفٍ عدِيِّ بْنِ حاتمٍ الطائِيِّ رضي اللّه عنه قال: سمعتُ رسولَ اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم يقُولُ: «مَنْ حَلَفَ عَلَى يمِينٍ ثُمَّ رَأَى أتقَى للّهِ مِنْهَا فَلْيَأْتِ التَّقْوَى» رواه مسلم.

Abu Tarif 'Adi ibn Hatim al-Ta'i (may Allah be pleased with him) said: I heard the Messenger of Allah (peace be upon him) say: "Whoever takes an oath and then sees that something else is more pleasing to Allah (more pious), let him do that which is more pleasing to Allah (that which constitutes greater piety)." Narrated by Muslim.

الشرح · explanation

حَلَف: أي أقسم. رأى أتقى: رأى غيرها خيرًا منها؛ أي أرضى للّه وأبعد عن معصيته.

Halafa: meaning he swore an oath. Ra'a atqa: he saw something else as better -- meaning more pleasing to Allah and farther from His disobedience.

وجوب التزام التقوى. من أقسم على فعل معصية، فعليه أن يخالف يمينه ويكفِّر عنها، ولا يفعل المعصية. اليمين على المستقبل هي التي فيها الكفارة، فإذا حلَف الإنسانُ على شيءٍ مستقبلٍ وخالف ما حلف عليه، وجبت عليه الكفارة، إلّا أن يُقْرن يمينه بمشيئة اللّه، فيقول: إن شاء اللّه، فهذا لا كفارة عليه ولو خالَف. الإنسان يستطيع أن يكفِّر عن يمينه قبل الحنث، ويستطيع أن يكفِّر بعد ذلك، فالإنسان في اليمين مخير بين الأمرين، ومن تقوى اللّه تبارك وتعالى أن يفعل الأفضل، والأنفع، والأحسن، ولا تمنعه اليمين من فعل الخير، والبرّ، والمعروف، والصلة. الكفارة إطعام عشرة مساكين من أوسط الطعام، أو كسوتهم، أو تحرير رقبة، ومن لم يجد شيئًا من ذلك صام ثلاثة أيام.

The obligation to adhere to piety (taqwa). Whoever swears to commit a sin must break his oath and make expiation for it, and must not commit the sin. The oath regarding a future matter is the one that carries expiation. If a person swears about something in the future and acts contrary to what he swore, he is obligated to make expiation, unless he appends his oath with the will of Allah (insha'Allah -- 'if Allah wills'), in which case there is no expiation upon him even if he acts contrary to it. A person may make expiation before breaking his oath, and he may also make expiation after breaking it. Regarding oaths, a person has the choice between the two options. Part of piety toward Allah is to do what is best, most beneficial, and most virtuous, and not to let an oath prevent one from doing good, kindness, and maintaining ties. The expiation is feeding ten poor persons from one's average food, or clothing them, or freeing a slave. Whoever cannot afford any of these must fast three days.
