عن عَمْرِو بنِ الأَحْوَصِ الجُشَمِيِّ رضي اللّهُ عنه أَنَّهُ سمِعَ النبيَّ صَلّى اللّهُ عَلَيْهِ وسَلَّم في حَجَّةِ الْوَداعِ يقُولُ بعد أَنْ حَمِدَ اللّه تعالى وَأَثنَى علَيْهِ وذكَّر ووعظَ، ثُمَّ قال: «أَلا واسْتَوْصوا بِالنِّساءِ خَيْرًا، فَإِنَّمَا هُنَّ عَوانٍ عَنْدَكُمْ، لَيْس تمْلكُونَ مِنْهُنَّ شَيْئًا غَيْرَ ذلِكَ إِلَّا أَنْ يأْتِينَ بِفَاحشةٍ مُبيِّنةٍ، فإِنْ فَعلْنَ فَاهْجُروهُنَّ في المضَاجعِ، واضْربُوهنَّ ضَرْبًا غَيْر مُبرِّحٍ، فإِنْ أَطعنَكُمْ فَلا تبْغُوا عَلَيْهِنَّ سبيلًا، أَلا إِنَّ لَكُمْ عَلَى نِسائِكُمْ حَقًّا، ولِنِسائِكُمْ عَلَيْكُمْ حقًّا، فَحَقُّكُمْ عَلَيْهنَّ أَن لا يُوطِئْنَ فُرُشَكُمْ منْ تَكْرهونَ، وَلا يَأْذَنَّ في بُيُوتكمْ لِمَن تكْرهونَ، أَلا وحقُّهُنَّ عَلَيْكُمْ أَن تُحْسنُوا إِلَيْهِنَّ في كِسْوَتِهِنَّ وَطعامهنَّ» رواه الترمذيّ، وقال:حديث حسن صحيح.
ʿAmr ibn al-Aḥwaṣ al-Jushamī (may Allah be pleased with him) reported that he heard the Prophet (peace be upon him) saying during the Farewell Pilgrimage — after praising Allah and extolling Him, then reminding and exhorting — "Indeed, treat women well, for they are captives with you. You do not have the right over them to anything other than that unless they commit a clear indecency. If they do, then shun them in the beds and strike them with a non-severe strike. If they obey you, then do not seek a way against them. Indeed, you have rights over your wives, and your wives have rights over you. Your right over them is that they not admit to your bed anyone you dislike and that they not allow into your houses anyone you dislike. عَوانٍ: أَيْ أَسِيرَات؛ شَبَّهَ رسولُ اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم المرْأَةَ في دُخُولِهَا تحْتَ حُكْمِ الزَّوْجِ بالأَسير. لَيْس تمْلكُونَ مِنْهُنَّ شَيْئًا غيْرَ ذلِكَ: أي لو حصلت منهنّ الطاعة والعشرة بالمعروف فلا يجوز لكم الاعتداء عليهنّ. فاحشة: كبيرة من كبائر الذنوب وسوء عشرة تستلزم التأديب، وليس المقصود هنا الزنى. مبيِّنة: أي يكون واضحًا منها نشوزُها وعدمُ انقيادها. الضَّربُ المُبرِّح: هُوَ الشَّاقُّ الشديدُ. فَلا تَبْغُوا عَلَيْهِنَّ سَبِيلًا: أَيْ لا تَطلُبوا طرِيقًا تحْتجُّونَ بِهِ عَلَيْهِنَّ وَتُؤذونهنَّ بِه. المضاجع: المراقد. لا يوطِئنَ فرشكم من تكرهون : أي لا يسمحنَ لأحد تكرهونه بدخول بيوتكم والجلوس في منازلكم، سواء كان المأذون له رجلًا أجنبيًّا أو امرأةً أو أحد محارم الزوجة.
"ʿAwān": captives; the Messenger of Allah (peace be upon him) likened the woman in her entering under the authority of the husband to a captive. "You have no right over them beyond that": meaning if they show obedience and kind companionship, you have no right to wrong them. "Indecency" (fāḥishah): a major sin and bad companionship requiring discipline, not meaning fornication here. "Clear" (mubayyinah): her rebellion and lack of compliance are evident. "Severe strike" (mubarriḥ): painful and harsh. "Do not seek a way against them": do not seek a means of argument against them to harm them. "The beds": the sleeping places. "Do not admit to your beds those you dislike": do not let anyone you dislike into your homes and sit in your houses, whether a foreign man, a woman, or a close relative of the wife.

قيام الحياة الزوجية على الحقوق المتبادلة بين الزوجين، واستقرارها يكون بأداء هذه الحقوق بمودّة وسخاء نفس. في تشبيه النبيّ صلّى اللّه عليه وسلّم للمرأة بالأسير مبالغة في استعطاف الزوج للرفق بها والقيام بحقّها. الوسائل التي يلجأ إليها الرجل لإصلاح ما بينه وبين زوجته كثيرة، فعليه أن يبدأ بوسائل الترغيب والتحفيز قبل غيرها. إن لم يحصل الإصلاح بالترغيب ينتقل إلى الموعظة ثم الهجر، فإن لم يُفِدْ ذلك يلجأ إلى الضرب غير المبرِّح؛ لأنّه متى أمكن الوصول إلى الغرض بالأخف لا يُعدَل إلى الأشد، لما في ذلك من النفرة المنافية لحسن المعاشرة. الضرب المسموح به هو ما كان قصده التأديب وإصلاح الشأن لا الانتقام والعقوبة والتشفّي، ويكون غير مبرِّح فلا يجرح ولا يشوِّه، ويجتنب فيه ضرب الوجه والرأس، وقد ورد ذلك في أحاديث أخرى. جواز الضرب مقيَّد بأن يُعلم أو يُظنّ أنّه يُصلحها، وهذا النوع من الضرب أهون في كثير من الأحيان من الطلاق الذي هو كسر للمرأة كما ورد في حديثٍ سابق. بيت الزوجية له حرمة لا يجوز للمرأة أن تسمح لأحد بالدخول إليه إلّا بإذن من الزوج. وجوب نفقة الزوجة وكسوتها على الرجل في حدود الاستطاعة عند عدم النشوز.
Marital life is built on reciprocal rights between spouses, and its stability lies in fulfilling these rights with affection and generosity. The Prophet's (peace be upon him) likening of woman to a captive is an appeal to the husband for gentleness toward her and fulfillment of her rights. A man has many means to reform matters between him and his wife; he should begin with encouragement and motivation before others. If reform does not come through encouragement, he moves to admonition, then separation; if that does not work, he resorts to non-severe striking — for whenever a goal can be reached by the mildest means, one should not turn to the harsher, as that produces aversion contrary to good companionship. Permissible striking is only that intended for discipline and reform, not for vengeance, punishment, or retaliation; it is non-severe, not wounding or disfiguring, and avoids the face and head, as confirmed in other hadiths. The permissibility of striking is conditional upon knowing or expecting that it will reform her, and this kind of striking is often easier than divorce, which is a "breaking" of the woman as mentioned in a previous hadith. The matrimonial home has a sanctity; the wife may not permit anyone to enter except with the husband's permission. The obligation of providing for the wife's food and clothing falls upon the man within his ability, absent rebellion.
