عن أبي هريرة رضي اللّه عنه قال: أَن رسول اللّه صَلّى اللّهُ عَلَيْهِ وسَلَّم قال: «لا يَمْنَعْ جارٌ جارَهُ أَنْ يغْرِزَ خَشَبَةً في جِدارِهِ» ثُمَّ يَقُولُ أَبو هريرة: مَا لي أَرَاكُمْ عنْهَا معْرِضِينَ، واللّهِ لأرمِيَنَّ بها بيْنَ أَكْتَافِكُمْ. متفقٌ عليه.
Abu Hurayrah (may Allah be pleased with him) reported: The Messenger of Allah (peace be upon him) said, "A neighbor should not prevent his neighbor from fixing a piece of wood in his wall." Then Abu Hurayrah said, "Why do I see you turning away from this? By Allah, I will cast it between your shoulders." [Agreed upon]
الشرح · explanation
رُوي «خَشَبَهُ» بالإِضَافَةِ والجمْعِ، ورُوِي «خَشبَةً» بالتَّنْوِينَ عَلَى الإِفْرَادِ. وقوله: ما لي أَرَاكُمْ عنْهَا مُعْرِضِينَ: يعني عنْ هذِهِ السُّنَّةِ. لأرمينّ: لأضربنّ، أي ألقيها بشدة. بين أكتافكم: المراد بينكم، والكلام فيه تشديد ولوم لهم.
It is narrated "khashabahu" (his wood) in the iḍāfah (possessive) and plural, and "khashabatan" with tanwīn in the singular. His statement "Why do I see you turning away from it": meaning from this Sunnah. "I will cast it": I will strike you with it; meaning I will throw it forcefully. "Between your shoulders": meaning among you; the statement contains severity and blame toward them.

المالك له أن يفعل في ملكه ما شاء. أهمّيّة تعاون الجيران والتسامح فيما بينهم، والتنازل عن بعض الحقوق بما ينفعهم ولا يضرهم. ليس للجار أن يمنع جاره من شيء ينفعه ولا يضره سواء كان في البناء، أو في غيره من مرافق الحياة. تعاون الجيران مظهر من مظاهر الأخوّة الإسلامية وتكافل المجتمع.
The owner has the right to do with his property what he wishes. The importance of cooperation among neighbors and forbearance with one another, and the yielding of some rights for their mutual benefit without harm. A neighbor cannot prevent his neighbor from something that benefits him and does not harm him, whether in building or other aspects of life. Cooperation among neighbors is a manifestation of Islamic brotherhood and social solidarity.
