عَنْ أَنسٍ رَضِيَ اللهُ عَنْهُ أَنَّ النَبِيَّ صَلّى اللهُ عَلَيْهِ وسَلَّم وَجَدَ تَمْرَةً في الطَّرِيقِ فقالَ: «لَوْلا أَنِّي أَخافُ أَنْ تَكُونَ مِنَ الصَّدَقَةِ لأَكَلْتُها». مُتَّفَقٌ عَلَيْهِ.
Anas (may Allah be pleased with him) reported that the Prophet (peace and blessings be upon him) found a date on the road and said: "Were it not that I fear it may be from the charity, I would have eaten it." Agreed upon.

من خصائص النَّبِيّ صلّى الله عليه وسلّم أنه لا يحل له أخذ الصدقة الواجبة التي هي الزكاة، ويشاركه في هذا الحكم آل بيته الكرام، لأن في ذلك شيء من ذلّ الآخذ وعز الباذل لا يليق بمقامه صلّى الله عليه وسلّم. جواز الانتفاع بما يجده الإنسان في الطريق من الأشياء الحقيرة التي يُعرِض الناس عنها غالبًا. على الإنسان إذا شكّ في إباحة شيء ألا يفعله.
It is among the distinctive qualities of the Prophet (peace and blessings be upon him) that it is not lawful for him to take the obligatory charity, which is zakah; his noble household shares with him in this ruling, because it involves a degree of the lowliness of the one who takes and the dignity of the one who gives, which does not befit his station (peace and blessings be upon him). The permissibility of benefiting from trivial things found on the road that people generally disregard. If a person is in doubt about whether something is permissible, he should not do it.
