عَن عائشةَ رَضِيَ اللهُ عَنْهَا: أَنَّ قُريشًا أَهَمَّهُمْ شَأْنُ المرأةِ المَخزُومِيَّةِ الَّتي سَرقَت، فقالوا: منْ يُكلِّمُ فيها رسولَ اللهِ صَلّى اللهُ عَلَيْهِ وسَلَّم؟ فقالوا: مَن يجتَرِئُ عليهِ إلّا أُسامةُ بنُ زيدٍ حِبُّ رسولِ اللهِ صَلّى اللهُ عَلَيْهِ وسَلَّم؟ فَكَلَّمهُ أُسامةُ، فقالَ رسولُ اللهِ صَلّى اللهُ عَلَيْهِ وسَلَّم: «أَتَشفعُ في حدٍّ مِنْ حُدُودِ اللهِ؟» ثمَّ قامَ فَاخْتَطَبَ، ثُمَّ قال: «إِنَّمَا أهْلَكَ الَّذِينَ قبلكُم أنَّهُم كانُوا إذَا سرقَ فِيهِمُ الشَّريفُ تَركُوهُ، وإذا سرقَ فِيهمُ الضَّعِيفُ أَقامُوا عليهِ الحدَّ! وايْمُ اللهِ، لوْ أنَّ فاطمَةَ بنتَ مُحَمَّدٍ سرقَتْ لقَطَعْتُ يَدهَا» مُتَّفَقٌ عَلَيْهِ.
A'ishah (may Allah be pleased with her) reported that the case of the Makhzumi woman who had stolen greatly troubled Quraysh. They said: "Who will speak to the Messenger of Allah (peace and blessings be upon him) about her?" They said: "Who would dare to do so but Usamah ibn Zayd, the beloved of the Messenger of Allah (peace and blessings be upon him)?" So Usamah spoke to him, and the Messenger of Allah (peace and blessings be upon him) said: "Are you interceding concerning one of the prescribed punishments of Allah?" Then he stood and delivered an address, and said: "Indeed, those before you were destroyed only because, when a noble person among them stole, they would let him go, but when a weak person among them stole, they would carry out the punishment upon him. By Allah, if Fatimah the daughter of Muhammad were to steal, I would cut off her hand." Agreed upon.

أن الشفاعة في الحدود بعد بلوغها الإمام منهي عنها شرعا. التفريق بين الناس في المعاملة ظلم يجلب الهلاك للأمة شرف الجاني لا يسقط الحد عنه، لأن أحكام الشرع يستوي فيها الشريف والوضيع. قضى الإسلام على الفوارق الاجتماعية والعصبيات القبلية فلا فرق أمام القضاء بين الناس ولو كان بعضهم قريبًا لحاكم أو لذي منصب، فتقام الحدود على من تثبت إدانته دون تفريق.
Interceding regarding the prescribed punishments after the case has reached the ruler is forbidden by the Sacred Law. Discriminating between people in their treatment is an injustice that brings destruction upon the nation. The nobility of the offender does not waive the prescribed punishment from him, because in the rulings of the Sacred Law the noble and the lowly are equal. Islam abolished social distinctions and tribal partisanship, so there is no difference before justice between people even if some of them are related to a ruler or a person of rank; the prescribed punishments are carried out upon whoever is proven guilty without distinction.
