عَنِ ابْنِ عُمَر رَضِيَ اللّهُ عَنْهُمَا قَالَ: قَالَ رَسُولُ اللّهِ صَلَّى اللّهُ عَلَيْهِ وَسَلَّمَ: «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَشْهَدُوا أَنْ لا إلَـٰهَ إِلّا اللّهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللّهِ، وَيُقِيمُوا الصَّلاةَ، وَيُؤتُوا الزَّكَاةَ، فَإذَا فَعَلُوا ذَلِكَ عَصَمُوا مِنِّي دِمَاءَهُمْ وَأمْوَالَهُمْ إِلّا بِحَقِّ الْإِسْلامِ، وَحِسَابُهُمْ عَلَى اللّهِ» مُتَّفَقٌ عَلَيْهِ.
Ibn Umar (may Allah be pleased with them both) reported: The Messenger of Allah (peace and blessings be upon him) said: "I have been commanded to fight the people until they testify that there is no god but Allah and that Muhammad is the Messenger of Allah, establish the prayer, and give the zakat. If they do that, they have protected from me their blood and their wealth, except by the right of Islam, and their reckoning is with Allah." Agreed upon (al-Bukhari and Muslim).

أن أقاتل: أي الكفرة، لا أهل الذمة ومن ألحق بهم. عصموا: منعوا وحفظوا. إلّا بحق الإسلام: أي إلا تنفيذًا لأحكام الإسلام فيمن أتى حدًا من حدود اللّهِ تعالى كالقصاص أو الزنا مع الإحصان أو الارتداد.
"To fight": that is, the disbelievers, not the protected non-Muslims (ahl al-dhimmah) and those given the same status. "They have protected": they have guarded and safeguarded. "Except by the right of Islam": that is, except in carrying out the rulings of Islam against one who commits an offense warranting a prescribed penalty of Allah the Exalted, such as retaliation (qisas), adultery by a married person, or apostasy.

لا يتوقف الجهاد مع الأعداء حتى يعلنوا شعائر الإسلام وأركانه الأساسية أو الخضوع إلى نظامه. الزكاة أحد شعائر الإسلام الأساسية وركن من أركانه. أنّ من أتى بالشهادتين فقد دخل في الإسلام، ثم يطالب بحق الإسلام، من الصلاة والزكاة والصيام والحج، فإن أدى ما أوجب اللّهُ عليه فهو مسلم حقًا، وإن لم يلتزم أخذ بحق الإسلام.
Jihad against the enemies does not cease until they proclaim the rites of Islam and its essential pillars, or submit to its order. Zakat is one of the essential rites of Islam and a pillar among its pillars. Whoever pronounces the two testimonies has entered Islam, then is required to fulfill the right of Islam: prayer, zakat, fasting, and pilgrimage. If he discharges what Allah has obligated upon him, he is truly a Muslim; and if he does not commit to it, he is held to account by the right of Islam.
