حديث 1357·الباب 235 · باب بيان جماعة من الشهداء في ثواب الآخرة ويغسلون ويصلى عليهم بخلاف القتيل في حرب الكفار·رياض الصالحين · Riyad Al Salihin

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللّهُ عَنْهُ قَالَ: جَاءَ رَجُلٌ إِلَى رَسُولِ اللّهِ صَلَّى اللّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: يَا رَسُولَ اللّهِ، أَرَأَيْتَ إِنْ جَاءَ رَجُلٌ يُرِيدُ أَخْذَ مَالِي؟ قَالَ: «فَلا تُعْطِهِ مَالَكَ» قَالَ: أَرأَيْتَ إِنْ قَاتَلَنِي؟ قَالَ: «قَاتِلْهُ» قَالَ: أَرَأَيْتَ إِنْ قَتَلَنِي؟ قَالَ: «فَأَنْتَ شَهِيدٌ» قَالَ: أَرَأَيْتَ إِنْ قَتَلْتُهُ؟ قَالَ: «هُوَ فِي النَّارِ» رَوَاهُ مُسْلِمٌ.

Abu Hurayrah (may Allah be pleased with him) reported: A man came to the Messenger of Allah (peace and blessings be upon him) and said: "O Messenger of Allah, what do you think if a man comes wanting to take my property?" He said: "Do not give him your property." He said: "What do you think if he fights me?" He said: "Then fight him." He said: "What do you think if he kills me?" He said: "Then you are a martyr." He said: "What do you think if I kill him?" He said: "He is in the Fire." Reported by Muslim.

الشرح · explanation

أرأيت: أخبرني. أخذ مالي: أي ظلمًا بغير حقّ.

"What do you think": tell me. "Take my property": that is, unjustly and without right.

جواز القتال دفاعًا عن المال إن عُدِم غيره من الوسائل، والحثّ عليه إن بادر الغاصب بالقتال. أنّ صاحب المال إن قُتِل إذ ذاك كان شهيدًا من حيث ثواب الآخرة، ولا تجري عليه أحكام الشهيد في الدنيا ولكن يغسل ويُصلى عليه، وإن قَتَلَ دفاعًا وهو لا يريد القتل فلا إثم عليه. الصائل المعتدي على المال إن قتلَ وسَلَبَ مستحلًا مال أخيه مهدرًا دمه كان في النار مخلدًا فيها. لا يخلد في النار من كان في قلبه مثقال ذرة من إيمان. المدافعة للمعتدى عليه تكون بالأسهل كالضرب والكلام والوعيد فإن لم يندفع الأذى إلا بالقتل ساغَ القتل.

The permissibility of fighting in defense of property when no other means is available, and the encouragement to do so if the usurper initiates the fighting. If the property's owner is killed in that case, he is a martyr with respect to the reward of the Hereafter, though the rulings of the martyr in this world do not apply to him—rather he is washed and prayed over; and if he kills in self-defense without intending to kill, there is no sin upon him. The aggressor who assaults the property, if he kills and plunders, deeming lawful his brother's property and shedding his blood, will be in the Fire, abiding therein. No one in whose heart is the weight of an atom of faith abides forever in the Fire. The one assaulted defends himself by the easiest means—such as striking, speech, and threats; and if the harm cannot be repelled except by killing, then killing becomes permissible.
