عَنْ أَبي أُمامةَ إِياسِ بْنِ ثعْلبَةَ الحَارِثِيِّ رضِـــيَ اللّه عَنْهُ أَنّ رسُول اللّه صَلّى اللّهُ عَلَيْهِ وسَلَّم قالَ: «منِ اقْتَطعَ حَقَّ امْرِىءٍ مسْلِمٍ بِيمِينِهِ، فَقَدْ أَوْجَب اللّه لَهُ النَّارَ، وحرَّم عَلَيْهِ الْجـنَّةَ» فَقالَ لَهُ رَجُلٌ: وإِنْ كَانَ شَيْئًا يسِيرًا يا رسُولَ اللّهِ؟ قَالَ: «وَإِنْ كان قَضِيبًا مِنْ أَراكٍ» رواهُ مُسْلِمٌ.
Abu Umamah Iyas ibn Thaʿlabah al-Harithi (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings be upon him) said: "Whoever seizes the right of a Muslim by his [false] oath, Allah has made the Fire obligatory for him and forbidden Paradise to him." A man said to him: "Even if it is something trivial, O Messenger of Allah?" He said: "Even if it is a twig of an arak tree." Reported by Muslim.

اقتطع: أخذ. بيمينه: أي بحلفه الكاذبة وهو يعلم. أراك: شجر يؤخذ منه عود السواك.
"Seizes (iqtataʿa)": takes. "By his oath (bi-yaminihi)": that is, by his false swearing while he knows [it to be false]. "Arak": a tree from which the siwak (tooth-stick) is taken.

عظم ذنب أكل حقوق الناس بالحلف الكاذب ولو كانت الحقوق يسيرة، فإنّ الظلم عاقبته وخيمة مهما كان قدر الظلم ولو كان بمقدار عود الأراك. أنّ الوعيد شامل لكل حقّ اقتطعه العبد ظلمًا بيمينه الفاجرة، سواء كان من مسلم أو من ذي عهد. أنّه عند التنازع والترافع للقاضي على المدعي البيّنة، وعلى المدَّعى عليه اليمين.
The gravity of the sin of consuming people's rights through false swearing, even if the rights are trivial; for injustice has a dire outcome, whatever its measure, even if it be the size of an arak twig. That the threat encompasses every right the servant seizes unjustly by his wicked oath, whether from a Muslim or from a person under covenant. That in disputes and litigation before the judge, the claimant must provide the proof (bayyinah), and the one against whom the claim is made must take the oath.
