حديث 1715·الباب 316 · باب ندب من حلف على يمين فرأى غيرها خيرًا منها أن يفعل ذلك المحلوف عليه ثم يكفّر عن يمينه·رياض الصالحين · Riyad Al Salihin

عَنْ عبْدِ الرَّحْمنِ بْنِ سَمُرةَ رضِي اللّه عَنْهُ قَالَ: قَالَ لي رسُولُ اللّه صَلّى اللّهُ عَلَيْهِ وسَلَّم: «وَإِذَا حَلَفْتَ علَى يَمِينٍ، فَرَأَيْت غَيْرَها خَيْرًا مِنهَا، فائْتِ الَّذِي هُوَ خَيْرٌ، وكفِّرْ عن يَمِينك» متفقٌ عليه.

Abd al-Rahman ibn Samurah (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) said to me: "And when you swear an oath and then see something better than it, then do that which is better, and make expiation for your oath." Agreed upon (al-Bukhari and Muslim).

الشرح · explanation

وإذا حلفت على يمين: بدأ بالحديث بواو العطف ليدل على أنّه جزء من حديث معطوف على ما قبله، والحلف: هو اليمين وجمع بينهما للتأكيد. غيرها: أي غير البرّ باليمين وهو فعل المقسم عليه. فائْت: فافعل. كفّر: افعل الكفّارة.

"And when you swear an oath": he began the hadith with the conjunction "and" to indicate that it is part of a hadith connected to what precedes it; al-half (swearing) is the oath, and the two words were combined for emphasis. "better than it": that is, other than fulfilling the oath, which is doing the thing sworn upon. "then do": that is, then perform it. "make expiation": perform the expiation.

يجوز للمسلم إذا حلف على أمر فرأى غيره أفضل منه أن يحنث في يمينه ويأتي ما هو خير ويكفّر عنها. جواز تقديم الكفّارة على الحنث عملًا بظاهر الأحاديث التي تدل على جواز التقديم. كفّارة اليمين: قال اللّه تعالى فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ [المائدة: ٨٩]. فإن عجز عن إطعام عشرة مساكين أو كسوتهم صام ثلاثة أيام لقوله سبحانه وتعالى: فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ [المائدة: ٨٩] والأَوْلَى أن تكون متتابعة.

It is permissible for a Muslim, if he swears about a matter and then sees something better than it, to break his oath, do what is better, and make expiation for it. The permissibility of offering the expiation before breaking the oath, acting upon the apparent meaning of the hadiths that indicate the permissibility of offering it beforehand. The expiation of the oath: Allah the Exalted said: "Its expiation is the feeding of ten needy persons from the average of that which you feed your own families, or clothing them, or the freeing of a slave" [Surah al-Ma'idah: 89]. If he is unable to feed ten needy persons or clothe them, he fasts three days, due to His saying (Glorified and Exalted is He): "But whoever cannot find [the means] — then a fast of three days" [Surah al-Ma'idah: 89]; and it is preferable that they be consecutive.
