عَنْ أَبي مَرْثَدٍ كَنَّازِ بْنِ الحُصَيْنِ رَضِيَ اللّه عَنْهُ قَالَ: سمِعْتُ رَسُولَ اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم يَقُولُ: «لا تُصَلُّوا إِلى القُبُورِ، وَلا تَجْلِسُوا علَيْها» رواه مُسْلِم.
Abu Marthad Kannaz ibn al-Husayn (may Allah be pleased with him) reported: I heard the Messenger of Allah (peace and blessings be upon him) say: "Do not pray toward graves, and do not sit upon them." Reported by Muslim.
الشرح · explanation
وَلا تَجْلِسُوا علَيْها: وهذا نَهيٌ عنِ الجُلوسِ عَلى القبرِ، وقدْ نَهى عنِ الجُلوسِ عَلى القَبرِ؛ لِما فيهِ مِن الاستِخفافِ بحَقِّ أَخيهِ المُسلمِ.
"And do not sit upon them": this is a prohibition against sitting on a grave. He forbade sitting on a grave because it involves making light of the right of one's Muslim brother.

تحريم الصلاة إلى القبر إن قصد استقباله، ويكره ذلك إن لم يقصده ولم يكن بينه وبينه حاجز، فإن كان حاجز ولم يقصد استقباله فلا كراهة، والحكمة من ذلك مخافة فتنة الوقوع في الشرك وتعظيم غير الله تعالى. تحريم الجلوس على القبر لما فيه من الإهانة للإنسان الذي كرمه اللّه تعالى ومثل الجلوس ما في معناه. قال النووي رحمه اللّه تعالى: قال أصحابنا: تجصيص القبر مكروه والقعود عليه حرام وكذا الاستناد إليه والاتكاء.
The prohibition of praying toward a grave if one intends to face it; this is disliked if one does not intend it and there is no barrier between him and it; but if there is a barrier and he does not intend to face it, there is no disapproval. The wisdom behind this is fear of the trial of falling into shirk and venerating other than Allah the Exalted. The prohibition of sitting on a grave, because it dishonors the human being whom Allah the Exalted has honored; and whatever carries the same meaning as sitting takes the same ruling. Al-Nawawi (may Allah the Exalted have mercy on him) said: Our companions [of the school] said: plastering a grave is disliked, sitting upon it is forbidden, and likewise leaning against it or reclining upon it.
