عَنْ أَبي هُرَيْرَةَ رَضِيَ اللّه عَنْهُ أَنَّ رَسُول اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم قَالَ: «اتَّقُوا الَّلاعِنَيْن» قَالُوا ومَا الَّلاعِنَانِ؟ قَالَ: «الَّذِي يَتَخَلَّى في طَريقِ النَّاسِ أَوْ في ظِلِّهِمْ» رواه مسلم.
Abu Hurayrah (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings be upon him) said: "Beware of the two [acts that provoke] curses." They said: What are the two [acts that provoke] curses? He said: "The one who relieves himself in the people's path or in their shade." Reported by Muslim.
الشرح · explanation
اتقوا اللاعنين: أي اتقوا الأمرين اللذين يجلبان لعنة الناس. يتخلى: يتغوط.
"Beware of the two [acts that provoke] curses (al-la'inayn)": that is, beware of the two acts that bring upon oneself the people's curse. "Relieves himself (yatakhalla)": defecates.

حمل الجمهور النهي الوارد في الحديث على التنزيه، وقال الشيخ زكريا الأنصاري: وينبغي تحريمه لما فيه من إيذاء المسلمين، والحديث ظاهر في التحريم، ونقل أنّه من الكبائر للعن فاعله. محل النهي عنه في الظل إذا كان معدًا للاجتماع المباح، أما لو كان لاجتماع محرم كميسر أو غيبة وقصد به تفريقهم فلا كراهة، ومثل الظل في الصيف محل الشمس في الشتاء. حرص الإسلام على تحقيق النظافة والوقاية من الأمراض والأوبئة، ومراعاة شعور الناس واحترام اجتماعهم على الخير.
The majority took the prohibition in the hadith to mean [mere] disapproval. Shaykh Zakariyya al-Ansari said: it ought rather to be forbidden, because it harms Muslims; the hadith apparently indicates prohibition, and it has been related that it is among the major sins, given that its doer is cursed. The prohibition regarding shade applies when it is a place set aside for permissible gathering; but if it is a place for a forbidden gathering, such as gambling or backbiting, and one intends thereby to disperse them, there is no disapproval. Like the shade in summer is a sunny spot in winter. Islam's keenness on achieving cleanliness, guarding against diseases and epidemics, considering people's feelings, and respecting their gathering for good.
