حديث 1775·الباب 355 · باب تحريم بيع الحاضر للبادي وتلقي الركبان والبيع على بيع أخيه والخطبة على خطبته إلّا أن يأذن أو يرد·رياض الصالحين · Riyad Al Salihin

عَنْ أَنَسٍ رَضِيَ اللّه عَنْهُ قَالَ: نَهَى رَسُولُ اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَإِنْ كَانَ أَخَاهُ لأَبِيه وَأُمِّهِ. متفق عليه.

Anas (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) forbade that a town-dweller sell on behalf of a bedouin, even if he were his brother by father and mother. Agreed upon (al-Bukhari and Muslim).

الشرح · explanation

الحاضر: هو المقيم في القرى والمدن. البادي: هو الذي يقطن في البادية. أن يبيع حاضر لباد: وهو أن يقدم البدوي بمتاع تعم الحاجة إليه ليبيعه بسعر يومه، فيقول له الحضري: دعه عندي لأبيعه لك بالتدريج، فيحرم لما فيه من الإضرار، أما لو قدم بما لا تعم الحاجة إليه من الأمتعة، أو بما تعم لكن ليبيعه على التدريج، فقال له الحضري: أنا أتولى لك ذلك، أو قال له: وكلني في بيعه بالسعر الحاضر فلا حرمة.

"The town-dweller (al-hadir)": one who resides in the villages and cities. "The bedouin (al-badi)": one who dwells in the desert countryside. "A town-dweller selling on behalf of a bedouin": this is when the bedouin comes with goods that people generally need, to sell them at the current day's price, and the town-dweller says to him, "Leave it with me and I will sell it for you gradually [at a higher price]." This is forbidden because of the harm it entails. But if the bedouin comes with goods that are not generally needed, or with goods that are needed yet he intends to sell them gradually, and the town-dweller says to him, "I will handle that for you," or, "Appoint me as your agent to sell it at the current price," then there is no prohibition.

النهي عن بيع الحضري للبدوي، لما في ذلك من التغرير بالسعر، وكذلك الحكم لو قدم حاضر فتلقاه باد كان الحكم كذلك، والنهي في الحديث للتحريم.

The prohibition against a town-dweller selling on behalf of a bedouin, because of the price manipulation it involves; and likewise the ruling applies if a town-dweller comes and a bedouin intercepts him. The prohibition in the hadith denotes forbiddance.
