حديث 1776·الباب 355 · باب تحريم بيع الحاضر للبادي وتلقي الركبان والبيع على بيع أخيه والخطبة على خطبته إلّا أن يأذن أو يرد·رياض الصالحين · Riyad Al Salihin

عَنِ ابْنِ عمَرَ رضي اللّه عَنْهُما قال: قالَ رَسول اللّه صَلّى اللّهُ عَلَيْهِ وسَلَّم: «لا تَتَلَقَّوُا السلَع حَتَّى يُهْبَطَ بِهَا إلى الأَسْواقِ» متفقٌ عليه.

Ibn Umar (may Allah be pleased with them both) reported: The Messenger of Allah (peace and blessings be upon him) said: "Do not intercept the goods until they are brought down to the markets." Agreed upon (al-Bukhari and Muslim).

الشرح · explanation

السلع: الأمتعة المجلوبة للبيع. حتى يهبط بها إلى الأسواق: أي حتى تصل إلى الأسواق ويعلم القادم بها السعر.

"The goods (al-sila')": merchandise brought for sale. "Until they are brought down to the markets": that is, until they reach the markets and the one bringing them comes to know the price.

تحريم تلقي الركبان وهم الذين يأتون بالسلع ليبيعوها في أسواق البلد، واشترط في التحريم العلم بالنهي عن التلقي، وأن يشتري المتلقي من الجالب من غير طلب منه وقبل قدومه البلد ومعرفته بالسعر، سواء قصد التلقي أم لا، كأن خرج لنحو صيد فلقي القادم فاشترى منه. الحكمة من تحريم هذا التصرف في الشرع لما فيه من الإضرار بصاحب السلعة والتغرير به.

The prohibition of intercepting the caravans — those who bring goods to sell them in the town's markets. For the prohibition to apply, it is conditioned upon knowledge of the prohibition against interception, and that the interceptor buys from the importer without any request from him and before the importer reaches the town and learns the price — whether he set out intending to intercept or not, such as one who went out for something like hunting, met the incoming trader, and bought from him. The wisdom behind the Law's prohibition of this practice is the harm and deception it causes to the owner of the goods.
