حديث 1778·الباب 355 · باب تحريم بيع الحاضر للبادي وتلقي الركبان والبيع على بيع أخيه والخطبة على خطبته إلّا أن يأذن أو يرد·رياض الصالحين · Riyad Al Salihin

عَنْ أَبي هُرَيْرَةَ رَضِيَ اللّه عَنْهُ قَالَ: نَهَى رَسُولُ اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَلا تَنَاجَشُوا ولا يبع الرَّجُلُ عَلى بَيْع أَخيهِ، ولا يخطبْ عَلى خِطْبَةِ أَخِيهِ، ولا تسْألِ المرأةُ طلاقَ أخْتِهَا لِتَكْفَأ مَا في إِنَائِهَا. وفي رِوَايَةٍ قَالَ: نَهَى رَسُولُ اللّه صَلّى اللّهُ عَلَيْهِ وسَلَّم عَنِ التَّلقِّي وأن يَبْتَاعَ المُهَاجِرُ لأَعْرابيٍّ، وأنْ تشْتَرِطَ المرْأَةُ طَلاقَ أُخْتِهَا، وَأنْ يَسْتَام الرَّجُلُ عَلى سوْمِ أخيهِ، ونَهَى عَنِ النَّجَشِ والتَّصْريةِ. متفقٌ عليه.

Abu Hurayrah (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) forbade that a town-dweller sell on behalf of a bedouin, [and said]: "Do not artificially inflate prices (najsh); let no man sell against his brother's sale, nor propose over his brother's marriage proposal; and let no woman ask for the divorce of her [fellow wife as a] sister so as to empty her vessel." In another narration he said: The Messenger of Allah (peace and blessings be upon him) forbade interception; that a townsman should trade on behalf of a bedouin; that a woman should stipulate the divorce of her sister; that a man should outbid over his brother's bargaining; and he forbade najsh (price-inflation) and tasriyah. Agreed upon (al-Bukhari and Muslim).

الشرح · explanation

لا تناجشوا: النجش: هو زيادة في ثمن السلعة لا لرغبة في الشراء بل ليخدع غيره. لتكفأ: لتقلب ما في إنائها، كناية عن رغبتها في أن ينكحها أو يصير لها من نفقته ومعاشرته الحسنة ما كان للمطلقة. التلقي: أي تلقي الركبان. أن يبتاع المهاجر: أي الحضري. للأعرابي: أي البدوي القادم بسلعته ليبيعها. أن يستام: أي يزيد في ثمن المبيع بعد أن تم الرضى به والاتفاق على ثمنه. التصرية: هي ترك حلب الدابة الحلوب ليجتمع اللبن في ضرعها فيتوهم المشتري كثرة لبنها وتعظم رغبته فيها.

"Do not engage in najsh": najsh is to raise the price of goods not out of a desire to buy, but to deceive another. "So as to empty her vessel (li-takfa'a)": to overturn what is in her vessel — a metaphor for her desire that he marry her, or that she obtain for herself the maintenance and good companionship that had belonged to the divorced woman. "Interception (al-talaqqi)": that is, intercepting the caravans. "That a townsman should trade": that is, the town-dweller. "On behalf of the bedouin (a'rabi)": that is, the desert-dweller who has come with his goods to sell them. "That he should outbid (yastam)": that is, to raise the price of the item after agreement upon it and its price had already been reached. "Tasriyah": leaving a milk-giving animal unmilked so that the milk gathers in its udder, causing the buyer to imagine that it yields abundant milk and to desire it all the more.

النهي عن هذه الصور من البيع لما فيها من الإيذاء والخداع والإضرار. النهي عن كل ما فيه تضييق على الناس وإضرار بهم، والابتعاد عن كل ما يحدث الفرقة والشقاق بين الأسر ويوغر الصدور بالحقد والكراهية.

The prohibition of these forms of sale because of the harm, deception, and injury they involve. The prohibition of everything that constricts people and harms them, and keeping away from all that sows division and discord among families and fills hearts with rancor and hatred.
