حديث 1779·الباب 355 · باب تحريم بيع الحاضر للبادي وتلقي الركبان والبيع على بيع أخيه والخطبة على خطبته إلّا أن يأذن أو يرد·رياض الصالحين · Riyad Al Salihin

عنِ ابْنِ عُمَرَ رضي اللّه عَنْهُمَا، أنَّ رَسُولَ اللّهِ صَلّى اللّهُ عَلَيْهِ وسَلَّم قَالَ: «لا يبِعْ بَعْضُكُمْ عَلى بَيْعِ بعْضٍ، ولا يَخْطُبْ على خِطْبة أخِيهِ إلّا أنْ يَأْذَنَ لَهُ» متفقٌ عليه، وهذا لَفْظُ مسلم.

Ibn Umar (may Allah be pleased with them both) reported that the Messenger of Allah (peace and blessings be upon him) said: "Let none of you sell against the sale of another, nor propose marriage over his brother's proposal, unless he gives him leave." Agreed upon (al-Bukhari and Muslim); this is the wording of Muslim.

الشرح · explanation

على خِطبة أخيه: أي طلب المرأة من وليها، وصورتها أن يخطب رجل امرأة فتقبل به ويتفقا ويتراضيا، أو تظهر أَمارات الرضا ولم يبق إلّا العقد فيجيء آخر وهو يعلم بكل هذا فيخطب على خطبة الأول.

"Over his brother's marriage proposal": that is, asking for a woman from her guardian. Its form is that a man proposes to a woman and she accepts him, and they agree and are mutually content — or signs of acceptance appear and nothing remains but the contract — then another man comes, knowing all of this, and proposes over the first man's proposal.

النهي عن البيع وقد تقدم بيان ذلك. النهي عن الخطبة على الخطبة، وهذا حرام، لما في ذلك من الإيذاء والتقاطع، ولهذا قيد لحديث إباحة الخطبة على الخطبة بترك الخاطب الأول أو إذنه. حكم عقد الزواج للخاطب الثاني أنّه صحيح ويكون الرجل آثمًا وعاصيًا لإقدامه على أمر منهي عنه. تحريم أن تخطب المرأة على خطبة امرأة أخرى إلحاقًا لحكم النساء بحكم الرجال.

The prohibition of [such a] sale, as has already been explained. The prohibition of proposing over another's proposal — this is forbidden, because of the hurt and estrangement it causes. Hence the permissibility of proposing over another's proposal is conditioned upon the first suitor's withdrawal or his permission. The ruling on the marriage contract of the second suitor is that it is valid, but the man is sinful and disobedient for having undertaken a forbidden act. The prohibition of a woman proposing over another woman's proposal, applying to women the same ruling as to men.
